TO ESTABLISH THE R. H. PATTERSON STUDY COMMITTEE TO MAKE A STUDY OF THE LAWS AND REGULATIONS GOVERNING THE SALE OF BEER AND WINE AND THE ALCOHOLIC BEVERAGE CONTROL ACT, TO PROVIDE FOR THE MEMBERSHIP OF THE COMMITTEE, AND TO REQUIRE THE COMMITTEE TO MAKE A REPORT OF ITS FINDINGS WITH RECOMMENDATIONS FOR STATUTORY AND ADMINISTRATIVE CHANGES BEFORE NOVEMBER 1, 2006, AFTER WHICH THE COMMITTEE TERMINATES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The study committee established by this joint resolution must be referred to as the R. H. Patterson Study Committee.
SECTION 2. There is established the R. H. Patterson Study Committee to conduct a complete review of the laws and regulations governing the sale of beer and wine in this State and the Alcoholic Beverage Control Act and regulations promulgated thereunder governing the sale of alcoholic beverages. The committee consists of nine members as follows:
(1) two members of the Senate appointed by the President Pro Tempore of the Senate;
(2) two members of the House of Representatives appointed by the Speaker of the House of Representatives;
(3) two members appointed by the Governor from the State at large;
(4) the director of the South Carolina Department of Revenue, ex officio, or his designee;
(5) the chief of SLED, ex officio, or his designee; and
(6) the president of the South Carolina College of Emergency Physicians, ex officio, or his designee.
Members shall serve without compensation, but may receive the mileage, subsistence, and per diem allowed by law for members of state boards, committees, and commissions to be paid from approved accounts of the Senate, House of Representatives, and Office of the Governor, as applicable. The committee must be assisted in its study by research staff provided by the House, Senate, and Office of the Governor, and the Department of Revenue. The committee shall review all aspects of this state's regulation of beer and wine and alcoholic beverages including, but not limited to, who can buy and sell these products, the hours these products may be sold and the manner that they can be consumed on the premises of establishments licensed to sell them, the license and permit structure, and criminal and civil penalties applicable for violations. The committee shall produce a report together with any recommendations for legislative and administrative changes its study has determined appropriate. This report must be forwarded to the President Pro Tempore of the Senate, the Speaker of the House of Representatives, and the Governor. The report and any recommendations must be completed before November 1, 2006. The existence of the committee terminates on the publication of its report and recommendations.
SECTION 3. A legislative enactment resulting from the recommendations of the committee established by this joint resolution must be cited as the "R. H. Patterson Act".
SECTION 4. This joint resolution takes effect upon approval by the Governor.
