That they have duly and carefully considered the same and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking SECTION 2 and inserting:
/SECTION 2. The commission shall consist of the following nine members:
(1) the Director of the Department of Parks, Recreation and Tourism or his designee, ex officio;
(2) the President of Francis Marion University or his designee, ex officio;
(3) the President of the Berkeley County Historical Society or his designee, ex officio;
(4) the President of the Colleton County Historical Society or his designee, ex officio;
(5) one member appointed by the President Pro Tempore of the Senate;
(6) one member appointed by the Speaker of the House;
(7) one member appointed by the Chairman of the Senate Finance Committee;
(8) one member appointed by the Chairman of the House Ways and Means Committee; and
(9) one member appointed by the Governor.
The members of the commission shall serve terms of four years and until their successors are appointed and qualify. Vacancies must be filled in the same manner as original appointment for the remainder of the unexpired term. The commission shall elect one of its members to serve as chairman for a term of two years. Commission members are not entitled to receive the subsistence, mileage, and per diem otherwise provided by law for members of state boards, committees, and commissions. /

EXPLANATION OF IMPACT:
The Department of Parks, Recreation & Tourism (PRT) indicates the agency could provide technical assistance to the Commission during the initial planning and design stages of the project at no additional cost. However, there may be an impact to the general fund depending on the extent to which the commission is able to generate other funds revenue and local matching funds to offset costs associated with trail operation and maintenance. PRT estimates minimum annual operating costs at $61,040 including salaries and fringe benefits for two FTEs to maintain the trail on a 7 day a week basis and $6,000 in operating expenses. Additional non-recurring costs may include trail development and the construction of facilities. Such one-time costs are not determinable until the commissions adopt a plan and issues recommendations.

This Joint Resolution would have no impact on general fund revenue in FY 2005-06.
Explanation
This JR creates the Francis Marion Trail Commission, which is authorized to solicit and raise funds from public and private sources toward development of this heritage and tourism trail in coordination with the Department of Parks, Recreation and Tourism (PRT). The trail would be included in PRT's State Trail System and be maintained by PRT.
While this JR authorizes the commission and provides means to solicit funds in support of expenditures toward creation and maintenance of a Francis Marion Trail, it would have no impact on general fund revenue in FY2005-06.

TO CREATE THE FRANCIS MARION TRAIL COMMISSION TO ESTABLISH A HERITAGE AND TOURISM TRAIL HONORING FRANCIS MARION'S REVOLUTIONARY CAMPAIGNS AND TO ESTABLISH THE COMMISSION'S MEMBERSHIP, DUTIES, AND RELATED MATTERS.
Whereas, the campaigns of General Francis Marion in the American Revolution are a source of inspiration and pride to the people of the State of South Carolina and the United States as a whole, and are recognized as having been instrumental in our country's fight for freedom; and
Whereas, the greater part of Francis Marion's campaigns took place in and immediately adjacent to the Pee Dee Region of South Carolina, particularly in the counties of Marion, Florence, Williamsburg, Horry, Georgetown, Berkeley, Charleston, Sumter, and Clarendon; and
Whereas, the sites associated with Francis Marion in this area are largely unexplored and undeveloped, and offer little or no access to the public; and
Whereas, it is recognized that an understanding and appreciation of these sites will promote an understanding and appreciation of our heritage and the price of the freedom that we enjoy; and
Whereas, the State of South Carolina believes that a tourism trail focusing on these Francis Marion sites and the area in which they are located will promote such goals as well as tourism in this area of South Carolina. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. There is created the Francis Marion Trail Commission for the purpose of establishing a heritage and tourism trail to be designated as the Francis Marion Trail. The commission is authorized to solicit and raise funds for the trail from public or private sources, and, in coordination with the Department of Parks, Recreation and Tourism, to designate the location and route of the trail to be included in the department's State Trail System. The commission is empowered and directed to raise private funds, to solicit and receive private and public grants, and to receive gifts to carry out the purpose for which the commission is created. If necessary for proper funding to establish the trail, the commission may recommend an appropriation for the trail. The Department of Parks, Recreation and Tourism shall provide the necessary staff and assistance to the commission. After the trail is established, the Department of Parks, Recreation and Tourism must maintain the trail as part of the State Trail System, however, the commission shall continue to raise public and private funds to assist in maintaining the trail.
