A BILL

TO AMEND SECTION 16-13-380, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE THEFT OF ELECTRIC CURRENT; AND TO AMEND SECTION 16-13-385, RELATING TO ALTERING, TAMPERING WITH, OR BYPASSING ELECTRIC, GAS, OR WATER METERS, SO AS TO PROVIDE THAT IN ADDITION TO THE CRIMINAL PENALTIES FOR THESE VIOLATIONS, A PERSON VIOLATING THE PROVISIONS OF THESE SECTIONS SHALL ALSO BE LIABLE TO THE ELECTRIC, GAS, OR WATER SUPPLIER IN AN AMOUNT EQUAL TO TRIPLE THE LOSSES OR DAMAGES SUSTAINED BY THE SUPPLIER AS A RESULT OF THE VIOLATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 16-13-380 of the 1976 Code is amended by adding a new paragraph at the end to read:

"In addition to the criminal penalties provided by this section, the person violating the provisions of this section shall also be liable to the electric supplier in an amount equal to triple the losses or damages sustained by the electric supplier as a result of the violation."

SECTION    2.    Section 16-13-385 of the 1976 Code is amended by adding a new subsection (C) to read:

"(C)    In addition to the criminal penalties provided by this section, the person violating the provisions of this section shall also be liable to the electric, gas, or water supplier in an amount equal to triple the losses or damages sustained by the electric, gas, or water supplier as a result of the violation."

SECTION    3.    This act takes effect upon approval by the Governor.
