A BILL

TO PROVIDE THAT THE DUTIES, FUNCTIONS, AND RESPONSIBILITIES OF ALL HEARING OFFICERS OF THE DEPARTMENT OF MOTOR VEHICLES ARE DEVOLVED UPON THE ADMINISTRATIVE LAW COURT EFFECTIVE JULY 1, 2005, AND TO PROVIDE THAT THESE HEARING OFFICERS AND THEIR DIRECT SUPPORT STAFF, TOGETHER WITH THE APPROPRIATIONS RELATING TO THESE EMPLOYEES, ARE TRANSFERRED TO THE ADMINISTRATIVE LAW COURT ON JULY 1, 2005.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The duties, functions, and responsibilities of all hearing officers of the Department of Motor Vehicles are devolved upon the Administrative Law Court effective July 1, 2005. These hearing officers and their direct support staff, together with the appropriations relating to these employees, are transferred to the Administrative Law Court on July 1, 2005. These hearing officers shall continue to exercise their present Department of Motor Vehicle functions, duties, and responsibilities under the auspices of the Administrative Law Court and shall perform such other functions and duties as the chief judge of the court shall provide. The Budget and Control Board shall cause all necessary actions to be taken to accomplish this transfer and shall prescribe the manner in which this transfer must be completed.

SECTION    2.    This act takes effect upon approval by the Governor.
