A BILL

TO AMEND ACT 1105 OF 1956, AS AMENDED, RELATING TO THE CREATION OF THE STARTEX-JACKSON-WELLFORD-DUNCAN WATER DISTRICT IN SPARTANBURG COUNTY, SO AS TO AUTHORIZE THAT ONE COMMISSIONER OF THE DISTRICT MAY RESIDE IN THE SERVICE AREA OF THE DISTRICT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 2 of Act 1105 of 1956 is amended to read:

"Section    2.    Such The district shall must be operated and managed by a commission to be known as 'Startex-Jackson-Wellford-Duncan Water Commission' which shall consist consists of five resident electors of the district and one member may be a resident of the service area of the district. The following persons shall constitute the initial members of the commission and shall serve for terms as follows: S. M. Snoddy and James E. Thomason for terms of six years; R. L. Cooley and Russell A. Huckaby for terms of four years; and Alvin H. Jones for a term of two years.

The regular terms of office of the members of the commission shall be are for six years. In all cases, the members of the commission shall hold until their successors qualify. The commission, except the initial members who are named herein in this act, shall must be appointed by the Governor upon the recommendation of the legislative delegation from the county, including the Senator. The initial terms shall begin as of the effective date of this act. Any A vacancy occurring in the office of commissioner by reason of death, resignation, or otherwise, shall must be filled for the remainder of the unexpired term by appointment by the Governor, upon the recommendation of a majority of the legislative delegation of Spartanburg County, including the Senator."

SECTION    2.    This act takes effect upon approval by the Governor.
