A BILL

TO AMEND SECTION 12-4-580, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO AUTHORITY OF THE DEPARTMENT OF REVENUE TO CONTRACT TO COLLECT AN OUTSTANDING LIABILITY OWED TO A GOVERNMENTAL ENTITY, SO AS TO PROVIDE THAT THE FEE CHARGED BY THE DEPARTMENT MUST BE PAID BY THE DEBTOR AND NOT THE GOVERNMENTAL ENTITY FOR WHOM THE DEBT IS COLLECTED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 12-4-580(B) of the 1976 Code, as last amended by Act 69 of 2003, is further amended to read:

"(B)    The department may charge and retain a reasonable fee for a collection effort made on behalf of a governmental entity. The amount of the fee must be negotiated between the governmental entity and the department paid by the debtor. The debtor must be given full credit toward the satisfaction of the debt for the amount of the fee collected by the department pursuant to this section."

SECTION    2.    This act takes effect upon approval by the Governor.
