A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-1-395 SO AS TO PROVIDE THAT BEGINNING JANUARY 1, 2007, A SCHOOL MAY NOT POSSESS, USE, OR PURCHASE ELEMENTAL MERCURY OR A MERCURY COMPOUND; AND TO PROVIDE THAT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL AND THE DEPARTMENT OF EDUCATION SHALL SPONSOR A SERIES OF MERCURY COLLECTION EVENTS THROUGHOUT THE STATE TO ENSURE THAT EXISTING MERCURY SUPPLIES ARE COLLECTED, REMOVED, AND RECYCLED PROPERLY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 5, Chapter 1, Title 59 of the 1976 Code is amended by adding:

"Section 59-1-395.    Beginning January 1, 2007, a school in this State may not possess, use, or purchase for use in the classroom elemental mercury or a mercury compound."

SECTION    2.    Within one year of the effective date of this act, the Department of Health and Environmental Control and the Department of Education shall sponsor a series of mercury collection events throughout the State to ensure that existing mercury supplies are collected, removed, and recycled properly.

SECTION    3.    This act takes effect upon approval by the Governor.
