A BILL

TO AMEND SECTION 50-3-316, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CRITERIA FOR HIRING NATURAL RESOURCES ENFORCEMENT OFFICERS, SO AS TO REVISE THE RESIDENCY REQUIREMENTS FOR THESE ENFORCEMENT OFFICERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-3-316 of the 1976 Code, as last amended by Act 458 of 1996, is further amended to read:

"Section 50-3-316.    In employing enforcement officers, the department shall use the criteria as required by the Office of Human Resources and the department. The criteria must include, but are not limited to, a written examination, physical examination, and interview. Each applicant is required to perform at minimal levels as required by the Office of Human Resources and the department. The department shall employ the most qualified applicants. An enforcement officer must reside within the county in which he is assigned or within thirty miles of the nearest county line of that county. If an enforcement officer does not reside in the county for which he is employed assigned or within thirty miles of the nearest county line, he shall move to the county in a manner to comply with the requirements of this section at his expense within three months of employment. Enforcement officers must be compensated from funds provided to the department in the annual general appropriation act."

SECTION    2.    This act takes effect upon approval by the Governor.
