A BILL

TO AMEND SECTION 50-3-316, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CRITERIA FOR HIRING NATURAL RESOURCES ENFORCEMENT OFFICERS, SO AS TO REVISE THE RESIDENCY REQUIREMENTS FOR THESE ENFORCEMENT OFFICERS.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-3-316 of the 1976 Code, as last amended by Act 458 of 1996, is further amended to read:

"Section 50-3-316.    In employing enforcement officers, the department shall use the criteria as required by the Office of Human Resources and the department. The criteria must include, but are not limited to, a written examination, physical examination, and interview. Each applicant is required to perform at minimal levels as required by the Office of Human Resources and the department. The department shall employ the most qualified applicants. An enforcement officer must reside within the county in which he is assigned, provided that the director, in his discretion with the concurrence of the legislative delegation of the county in which the officer is assigned, may allow an officer to reside outside the county under special hardship circumstances. If an enforcement officer does not reside in the county for which he is employed, he shall move to the county at his expense within three months of employment. Enforcement officers must be compensated from funds provided to the department in the annual general appropriation act."

SECTION    2.    This act takes effect upon approval by the Governor.
