A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-101-435 SO AS TO PROVIDE THAT BEGINNING WITH TUITION AND FEES FOR THE 2007 FALL SEMESTER, TUITION AND FEES FOR IN-STATE UNDERGRADUATES AT STATE-SUPPORTED HIGHER EDUCATION INSTITUTIONS MAY NOT BE INCREASED MORE THAN THE PERCENTAGE INCREASE IN THE PREVIOUS YEAR'S HIGHER EDUCATION PRICE INDEX, TO PROVIDE EXCEPTIONS, AND TO REQUIRE THE COMMISSION ON HIGHER EDUCATION TO FURNISH CERTAIN INFORMATION IN REGARD TO THIS REQUIREMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 101, Title 59 of the 1976 Code is amended by adding:

"Section 59-101-435.    (A)    Beginning with tuition and fees for the 2007 fall semester, tuition and fees for in-state undergraduates at state-supported higher education institutions as defined in Section 59-103-5 may not be increased more than the percentage increase in the previous year's Higher Education Price Index.

(B)    If an institution's tuition and fees are below the state average for tuition and fees as determined by the Commission on Higher Education for institutions of that type, then the provisions of this section do not apply.

(C)    Beginning in 2008, the Commission on Higher Education must include on its homepage financial information on each institution's compliance with this requirement. The Commission on Higher Education must also provide on its homepage a multi-year trend analysis on tuition and fees for in-state undergraduates at state-supported higher education institutions relative to other southeastern states."

SECTION    2.    This act takes effect upon approval by the Governor.
