TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-7-65 SO AS TO PROVIDE THAT A HOSPITAL OR UNIVERSITY THAT RECEIVES STATE FUNDING MUST NOT CONDUCT CLINICAL TRIALS UNLESS THESE TRIALS ARE REGISTERED WITH THE OFFICE OF RESEARCH AND STATISTICS OF THE BUDGET AND CONTROL BOARD AND THE TRIAL RESULTS ARE REPORTED TO THE OFFICE AND MADE AVAILABLE TO THE PUBLIC.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 7, Title 44 of the 1976 Code is amended by adding:
"Section 44-7-65. Notwithstanding any other provision of law, any hospital or university in this State that receives state funding, including Medicaid, may not conduct clinical trials unless the hospital or university registers the clinical trial with the Office of Research and Statistics of the Budget and Control Board established pursuant to Section 44-6-170, and reports the results of these trials to the office, which shall make these results available to the public in a manner and form determined by the office."
SECTION 2. This act takes effect upon approval by the Governor.
