TO AMEND SECTION 16-3-20 OF THE 1976 CODE, BY ADDING ARSON TO THE LIST OF CRIMES INCLUDED IN THE STATUTORY AGGRAVATING CIRCUMSTANCES FOR PURPOSES OF THE DEATH PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 16-3-20(C)(a)(1) of the 1976 Code, as amended by Act 342 of 2006, is amended by adding an appropriately numbered item at the end to read:

"( )    arson in the first degree as defined in Section 16-11-110(A)."

SECTION    2.    This act takes effect upon approval by the Governor.
