A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-3-785, TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION SHALL DESIGN AND ERECT SIGNS THAT PROMOTE MOTORCYCLE SAFETY ALONG THE STATE'S HIGHWAYS, AND TO PROVIDE THAT THE DEPARTMENT SHALL CONVENE A COMMITTEE TO ADVISE THE DEPARTMENT'S DIRECTOR ON THE DESIGN AND LOCATION OF THE SIGNS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 7, Chapter 3, Title 57 of the 1976 Code is amended by adding:

"Section 57-3-785.    (A)    The Department of Transportation shall design and erect along the state's highways traffic signs that promote motorcycle safety at locations where motorcycle fatalities have occurred within three years before the erection of the sign.

(B)    The department may not erect a sign pursuant to this section unless the department determines that this action will not result in the loss of any federal funds to the State, and the cost of erecting, maintaining, and replacing the sign will not be paid from state funds.

(C)    The department shall convene a committee to advise the Director of the Department of Transportation on the design and location of motorcycle safety signs erected pursuant to this section. The members of the advisory committee shall serve without compensation and consist of four members appointed by the Governor, three members appointed by the director with expertise in the design and placement of traffic signs, one member of the House of Representatives appointed by the Speaker of the House of Representatives, and one member of the Senate appointed by the Speaker Pro Tempore of the Senate. The committee is dissolved on December 31, 2009."

SECTION    2.    This act takes effect upon approval by the Governor.
