A BILL

TO AMEND SECTION 40-22-280, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXCEPTIONS FROM REGULATION OF LAND SURVEYORS, SO AS TO ALLOW A LAND SURVEYOR TO PREPARE A PLAT OF PROPERTY FOR AN AGENCY OF THE UNITED STATES GOVERNMENT PURSUANT TO APPLICABLE FEDERAL REGULATIONS, TO PERMIT THE EXCEPTION WHERE A PLAT DOES NOT MEET THE MINIMUM STANDARDS FOR A LAND SURVEY IN THIS STATE, TO RESTRICT THE USE OF A PLAT PREPARED UNDER THIS SUBSECTION TO AN AGENCY OF THE UNITED STATES GOVERNMENT; AND TO PROVIDE A DISCLAIMER REQUIREMENT FOR A PLAT PREPARED PURSUANT TO THIS ACT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 40-22-280 of the 1976 Code, as last amended by Act 311 of 2000, is further amended by adding an appropriately lettered subsection to read:

"( )    Notwithstanding another provision of law, a land surveyor may prepare, sign, and seal a map showing a boundary or approximate boundary of real property situated in this State, provided:

(1)    the map is prepared for the exclusive use of an agency of the United States government;

(2)    the map is not used to create or establish a boundary line for another purpose in this State;

(3)    a purported conveyance of property based upon a boundary shown on a map prepared by a land surveyor under this section is void;

(4)    a surveyor who prepares, signs, or seals a map prepared pursuant to this section shall include the citation of a federal regulation authorizing preparation of the map;

(5)    the map includes a disclaimer prominently stating:

'WORK PERFORMED IN PREPARING THIS PLAT DOES NOT SATISFY REQUIREMENTS OF THE MINIMUM STANDARDS MANUAL FOR THE PRACTICE OF LAND SURVEYING IN SOUTH CAROLINA. THIS PLAT IS NOT VALID FOR USE IN THE CONVEYANCE OF LAND IN THIS STATE. USE OF THIS PLAT IS RESTRICTED TO AN AGENCY OF THE UNITED STATES GOVERNMENT'."

SECTION 2.    This act takes effect upon approval by the Governor.
