A BILL

TO AMEND SECTION 20-7-95, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PARENTAL IMMUNITY IN CASES OF INCORRIGIBILITY OF A SEVENTEEN-YEAR-OLD CHILD, SO AS TO PROVIDE THAT IMMUNITY ALSO APPLIES IN CASES OF NEGLIGENT SUPERVISION IF THE CHILD IS EXCLUDED FROM THE HOME AND THERE IS A DEMONSTRABLE RECORD THAT THE CHILD IS INCORRIGIBLE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 20-7-95 of the 1976 Code, as added by Act 450 of 1996, is amended to read:

"A parent, guardian, or other person responsible for the care and support of a child may not be charged with unlawful neglect of a child, cruelty to a child, failure to provide reasonable support of a child, negligent supervision, or a similar offense based on the exclusion from the home of a seventeen-year-old child where there is a demonstrable record that the child is incorrigible, (beyond the control of parents)."

SECTION    2.    This act takes effect upon approval by the Governor.
