A BILL

TO AMEND SECTION 42-17-90, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REVIEW OF AN AWARD BY THE WORKERS' COMPENSATION COMMISSION WHEN THERE HAS BEEN A CHANGE IN CONDITION, SO AS TO EXTEND FROM TWELVE MONTHS TO TWO YEARS THE PERIOD FOR REQUESTING THE REVIEW OF AN AWARD FOR A CHANGE IN CONDITION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 42-17-90 of the 1976 Code is amended to read:

"Section 42-17-90.    Upon its own motion or upon the application of any a party in interest on the ground of a change in condition, the commission may review any an award and on such this review may make an award ending, diminishing, or increasing the compensation previously awarded, subject to the maximum or minimum provided in this title, and shall immediately shall send to the parties a copy of the order changing the award. No such A review shall does not affect such the award as regards any moneys regarding money paid and no such the review shall may not be made after twelve months two years from the date of the last payment of compensation pursuant to an award under provided by this title."

SECTION    2.    This act takes effect upon approval by the Governor.
