A BILL

TO AMEND SECTION 11-35-5270, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SMALL AND MINORITY BUSINESS ASSISTANCE OFFICE, SO AS TO PROVIDE THAT IT SHALL NOT IMPOSE A MINIMUM AMOUNT OF TIME FOR WHICH A BUSINESS MUST OPERATE BEFORE BECOMING ELIGIBLE FOR CERTIFICATION AS A MINORITY FIRM IN THIS STATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 11-35-5270 of the 1976 Code, as last amended by Act 376 of 2006, is further amended by adding an appropriately numbered item at the end to read:

"( )    Notwithstanding another provision of law, the SMBAO may not require a business to operate for a minimum amount of time before being eligible for certification as a minority firm."

SECTION    2.    This act takes effect upon approval by the Governor.
