A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-101-430 SO AS TO DENY POSTSECONDARY EDUCATION BENEFITS ON THE BASIS OF RESIDENCE TO A PERSON UNLAWFULLY WITHIN THE UNITED STATES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 101, Title 59 of the 1976 Code is amended by adding:

"Section 59-101-430.    An individual who is not lawfully present in the United States is not eligible on the basis of residence within the State for:

(1)    a postsecondary education benefit including, but not limited to, scholarships or financial aid; or

(2)    resident tuition."

SECTION    2.    This act takes effect upon approval by the Governor.
