A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 5-25-635 SO AS TO PROVIDE THAT THE OWNER OF A BUILDING WITH A FLOOR OR CEILING CONSTRUCTED WITH TRUSS CONSTRUCTION MUST ATTACH TO THE BUILDING AN EMBLEM IDENTIFYING THE BUILDING AS HAVING TRUSS CONSTRUCTION, TO PROVIDE SPECIFICATIONS OF THE EMBLEM'S APPEARANCE AND LOCATION, TO PROVIDE AN EXEMPTION FOR A BUILDING WITH TRUSS CONSTRUCTION THAT IS A DETACHED ONE- OR TWO-FAMILY RESIDENTIAL STRUCTURE THAT IS NOT PART OF A PLANNED REAL ESTATE DEVELOPMENT, AND TO PROVIDE AN EXEMPTION FOR AN INDIVIDUAL STRUCTURE OR DWELLING UNIT THAT IS PART OF A PLANNED REAL ESTATE DEVELOPMENT BUT HAS A TRUSS CONSTRUCTION IDENTIFYING EMBLEM CONSPICUOUSLY ATTACHED TO THE DEVELOPMENT'S ENTRANCES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 7, Chapter 25, Title 5 of the 1976 Code is amended by adding:

"Section 5-25-635.    (A)    The owner of a building with a floor or ceiling constructed with truss construction must attach to the building an emblem that identifies the building as having truss construction.

(B)    The emblem must:

(1)    be permanently affixed to the left of the main entrance door at a height between four feet and six feet above the ground;

(2)    be of a bright and reflective color or made of a reflective material;

(3)    be in the shape of an isosceles triangle measuring twelve inches horizontally and six inches vertically;

(4)    have conspicuously printed on it the following letters, as appropriate, based on the type of truss construction used in the building being identified by the emblem:

(a)    'F' to signify a floor with truss construction;

(b)    'R' to signify a roof with truss construction; or

(c)    'F/R' to signify both a floor and roof with truss construction.

(C)    This section does not apply to a building with truss construction that is a detached one- or two-family residential structure that is not part of a planned real estate development.

(D)    An individual structure or dwelling unit with truss construction is not required to have an emblem as otherwise required by this section if it is part of a planned real estate development that has such an emblem conspicuously attached to the development's entrances."

SECTION    2.    This act takes effect upon approval by the Governor.
