VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 24-3-220 SO AS TO PROVIDE CRITERIA FOR THE TRANSPORT OF PERSONS IN THE CUSTODY OF THE DEPARTMENT OF CORRECTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 3, Title 24 of the 1976 Code is amended by adding:
"Section 24-3-220. (A) A person in the custody of the Department of Corrections may not be transported except as required by medical necessity or for a specific law enforcement, judicial or other purpose as required or identified by the department.
(B) A transport permitted under subsection (A) of this section must be conducted by the department. However, when the transport is the result of a request of a local or state law enforcement agency, the agency may transport the person if approved by the department."
SECTION 2. This act takes effect upon approval by the Governor.
