A JOINT RESOLUTION

TO CREATE A COMMITTEE TO STUDY THE LAWS, REGULATIONS, AND POLICIES OF THIS STATE REGARDING ILLEGAL DRUGS AND CONTROLLED SUBSTANCES, AND TO REQUIRE THE STUDY TO INCLUDE THE APPLICATION, IMPLEMENTATION, AND ENFORCEMENT OF THESE LAWS, REGULATIONS, AND POLICIES AND THEIR RESULTING EFFECTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    A committee is hereby created to study the laws, regulations, and policies of this State regarding illegal drugs and controlled substances. This study shall include the application, implementation, and enforcement of these laws, regulations, and policies and their resulting effects. The report may include recommendations, if appropriate, for legislative changes necessary to implement the committee's recommendations.

(B)    The study committee must be composed of nine members as follows:

(1)    the majority leader and the minority leader of the House of Representatives and the Senate shall each appoint one member;

(2)    the Attorney General shall appoint one member;

(3)    the Chief Justice shall appoint one member;

(4)    the Governor shall appoint one member;

(5)    the Superintendent of Education or the superintendent's designee shall serve as an ex officio member; and

(6)    the Director of the Department of Corrections or the director's designee shall serve as an ex officio member.

(C)    The committee shall render its report and recommendations to the chairman of the Senate Judiciary Committee, the chairman of the House Judiciary Committee, and the Governor no later than January 9, 2008, at which time the committee must be dissolved.

(D)    Members of the committee shall serve until their successors are appointed and qualify, and vacancies must be filled for the remainder of the unexpired term in the manner of original appointment. Members shall serve until the expiration date of the committee.

(E)    The committee shall meet within thirty days after the appointment of all its members upon the call of the Governor and organize by electing a chairman, vice chairman, and such other officers as considered necessary.

(F)    The chairman of the Senate Judiciary Committee and the chairman of the House Judiciary Committee shall provide staffing for the committee.

(G)    Members of the committee may receive per diem, subsistence, and mileage as provided by law for members of state boards, committees, and commissions to be paid from the approved accounts of the entity of the public official who appointed the member.

SECTION    2.    This joint resolution takes effect upon approval by the Governor, and the study committee established in Section 1 of this joint resolution dissolves upon the filing of its report.
