EXPLANATION OF IMPACT:
Adjutant General's Office
The office reports that it would require 5.00 new FTEs for a GIS Manager, two GIS Analysts, a Database Administrator I, and a Data Coordinator II at an annual cost to the general fund of $371,000 for salary, fringe and other operating expenses. There would also be a non-recurring cost to the general fund of $105,000 for startup operating expenses and $1,200,000 for in-depth contractual implementation costs. Total first year cost and impact on the general fund is $1,676,000. The agency would then seek federal funds to replace the non-recurring contractual costs and would use this funding for the maintenance of data.
State Law Enforcement Division - SLED
At this time the agency has not reported that there will be any impact on the General Fund of the State or on federal and/or other funds.

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 11 TO CHAPTER 3, TITLE 23 SO AS TO PROVIDE THAT THE SOUTH CAROLINA EMERGENCY MANAGEMENT DIVISION SHALL CREATE AND OPERATE A STATEWIDE FIRST RESPONDER BUILDING MAPPING INFORMATION SYSTEM.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The members of the General Assembly recognize the extreme dangers present when the safety of our citizens requires first responders such as police and fire fighters to evacuate and secure a building. In an effort to prepare for responding to unintended disasters, criminal acts, and acts of terrorism, the General Assembly intends to create a statewide first responder building mapping information system that will provide all first responders with the information they need to be successful when disaster strikes. The first responder building mapping system is to be developed for a limited and specific purpose and is not to be construed as imposing standards or system requirements on any other mapping systems developed and used for any other local government purposes.
SECTION 2. Chapter 3, Title 23 of the 1976 Code is amended by adding:
Section 23-3-900. (A) The South Carolina Emergency Management Division (SCEMD) shall create and operate a statewide first responder building mapping information system.
(B) All state agencies must and local governments may utilize building mapping software that complies with the building mapping software standards established under Section 23-3-910 for any building mapped for this purpose after the statewide first responder building mapping information system is operational.
(C) All state-owned buildings that are occupied by state government employees must be mapped.
(D) Once the statewide first responder building mapping information system is operational, all state buildings that are mapped must forward their building mapping information data to SLED.
(E) Consistent with the guidelines developed under Section 23-3-910, SCEMD shall electronically make the building mapping information available to all state, local, and federal law enforcement agencies and fire departments.
(F) Consistent with the guidelines developed under Section 23-3-910, SCEMD shall develop building mapping software standards that must be used to participate in the statewide first responder building mapping information system.
(G) SCEMD shall pursue federal funds to:
(1) create the statewide first responder building mapping information system; and
(2) develop grants for the mapping of all state government buildings.
(H) All tactical and intelligence information provided to SCEMD under this article is exempt from public disclosure under the Freedom of Information Act.
Section 23-3-910. The South Carolina Emergency Division shall:
(1) develop the type of information to be included in the statewide first responder building mapping information system. The information shall include, but is not limited to: floor plans, fire protection information, evacuation plans, utility information, known hazards, and text and digital images showing emergency personnel contract information;
(2) develop building mapping software standards that must be utilized by all entities participating in the statewide first responder building mapping information system;
(3) determine the order in which buildings must be mapped;
(4) develop guidelines on how the information must be made available. These guidelines shall include detailed procedures and security systems to ensure that the information is made available only to the government entity that either owns the building or is responding to an incident at the building; and
(5) recommend training guidelines regarding using the statewide first responder building mapping information system.
Section 23-3-920. (A) A local governmental entity may establish a first responder building mapping information system or participate in the statewide first responder building mapping information system.
(B) A personal residence or business may be included in a local government or the state's mapping information system, or both."
SECTION 3. This act takes effect upon approval by the Governor.
