To whom was referred a Bill (H. 3131) to amend Article 22, Chapter 3, Title 56, relating to the issuance of special motor vehicle license plates to certain current and retired elected officials, so as to provide, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by deleting lines 27, 28, 29, and 30 of SECTION 1, page 1, and inserting:

/ Special License Plates; Former Members of the South Carolina Delegation of the United States Congress, Members of Municipal and County Councils, Coroners, Mayors, and Members of the General Assembly Receiving Retirement Benefits /

Amend the bill further Section 56-3-2150, as contained in SECTION 1, page 1, by deleting lines 33 and 34, and inserting:

Amend the bill further, Section 56-3-2150, as contained in SECTION 1, by deleting line 42 on page 1 and line 1 on page 2, and inserting:

/ Section 56-3-2020, and only one plate may be issued to a former member of the South Carolina Delegation of the United States Congress, councilman, coroner, /

When amended SECTION 1 shall read:

/ SECTION    1.    Article 22, Chapter 3, Title 56 of the 1976 Code is amended to read:

"Article 22

Special License Plates; Former Members of the South Carolina Delegation of the United States Congress, Members of Municipal and County Councils, Coroners, Mayors, and Members of the General Assembly Receiving Retirement Benefits

Section 56-3-2150.    The Department of Motor Vehicles may issue special motor vehicle license plates to former members of the South Carolina Delegation of the United States Congress, members of municipal and county councils, county coroners, and mayors of this State for private passenger motor vehicles owned by them. The department also may issue special motor vehicle license plates to former members of the General Assembly who are eligible to receive retirement benefits under the General Assembly Retirement System for private passenger motor vehicles owned by them. The biennial fee for these special license plates is the same as the fee provided in Section 56-3-2020, and only one plate may be issued to a former member of South Carolina Delegation to the United States Congress, councilman, coroner, mayor, or member of the General Assembly who is receiving retirement benefits. The plate must be issued or revalidated biennially for the regular registration and licensing period.

Section 56-3-2160.    The special plates must be of the same size as regular motor vehicle license plates, but must be of a distinctive design and bear those letters and numerals the Department of Motor Vehicles prescribes. The plates must be issued or revalidated biennially for the regular registration and licensing period.

Section 56-3-2170.    The license plate issued pursuant to this article may be transferred to another vehicle of the same weight class owned by the same person upon application being made to and approved by the Department of Motor Vehicles. It is unlawful for any a person to whom such a this plate has been issued to knowingly permit it to be displayed on any a vehicle except the one authorized by the department. If a holder of such a this plate ceases to be a member of the municipal or county council or ceases to be county coroner, or mayor he shall immediately shall return the plate to the department.

Section 56-3-2180.    The provisions of this article do not affect the registration and licensing of motor vehicles as required by other provisions of this chapter but are cumulative thereto to them. Any A person violating the provisions of this article or any a person who (a) fraudulently gives false or fictitious information in any application for a special license plate, as authorized in this article, (b) conceals a material fact, or (c) otherwise commits a fraud in any application or in the use of any a special license plate issued is guilty of a misdemeanor and, upon conviction, must be punished by a fine of not more than one hundred dollars, or by imprisonment for not more than thirty days." /

STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT 1/

This bill is expected to raise DMV earned funds by $42 and Motor Vehicle License revenues within the general fund by $48 in FY 2007-08.

Explanation

This bill, as amended in subcommittee, makes a former member of the U.S. Congress from this state eligible for one special license plate under this section. A special fee of $30 applies to each plate and is in addition to the regular ($24/auto or $30/truck) biennial registration fee. Special fee proceeds, net of production costs retained by DMV, go to the state general fund. Pursuant to temporary proviso 36A.18, Part 1B of Act 397 of 2006, these plates expire annually on January thirty-first of each year. Furthermore, effective July 1, 2007, under Section 56-3-910 (B), proceeds of the $24 regular registration fee are distributed as follows: $2 to DMV's plate replacement fund; $22 to the State Highway Account of the S.C. Transportation Infrastructure Bank (SIB).

Based on a review of DMV records for this plate series, there are approximately ten active plates, of which one is for a truck. Based on our review, another twelve former members reside in this State and are eligible for the plate. We estimate no more than six plates only for autos would be issued in the initial year. Multiplying six plates times an annualized cost of $15 yields $90, of which $42 would be retained by DMV for costs and the balance of $48 would go to the state general fund. Adoption of this bill would therefore raise DMV earned funds by $42 and Motor Vehicle License revenues within the general fund by $48 in FY 2007-08. Since there is no change in rate or distribution of the regular biennial fee, this bill would not impact applicable state revenue distributions in FY 2007-08.

TO AMEND ARTICLE 22, CHAPTER 3, TITLE 56, RELATING TO THE ISSUANCE OF SPECIAL MOTOR VEHICLE LICENSE PLATES TO CERTAIN CURRENT AND RETIRED ELECTED OFFICIALS, SO AS TO PROVIDE FOR THE ISSUANCE OF SPECIAL LICENSE PLATES TO RETIRED MEMBERS OF THE UNITED STATES CONGRESS, AND TO MAKE TECHNICAL CHANGES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 22, Chapter 3, Title 56 of the 1976 Code is amended to read:

SECTION    2.    This act takes effect upon approval by the Governor.
