TO AMEND SECTION 59-40-190, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE BOARD OF TRUSTEES OF A CHARTER SCHOOL, SO AS TO PROVIDE THAT A CHARTER SCHOOL CHARTERED BEFORE 2006 MAY HAVE A MEMBER OF THE SCHOOL GOVERNING BODY WHO ALSO RECEIVES PAY AS AN EMPLOYEE OF THE SAME SCHOOL.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 59-40-190(D) of the 1976 Code, as last amended by Act 274 of 2006, is further amended to read:
"(D) A member of a school governing body may not receive pay as an employee in the same school. However, a charter school that was chartered before 2006 may have a member of the school governing body who also receives pay as an employee of the same school."
SECTION 2. This act takes effect upon approval by the Governor.
