A JOINT RESOLUTION

TO PROVIDE THAT FOR FISCAL YEAR 2006-2007 ALL INTEREST ACCRUING ON FUNDS COLLECTED AND HELD BY THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL PURSUANT TO SECTION 44-56-160 MUST BE CREDITED TO THE HAZARDOUS WASTE CONTINGENCY FUND AND AUTHORIZED FOR CERTAIN HAZARDOUS WASTE-RELATED EXPENDITURES BY THE DEPARTMENT.

Whereas, it was the intent of the General Assembly to allow all interest accruing to the Hazardous Waste Contingency Fund as authorized by Section 44-56-160 to be credited to the fund for use by the department to defray costs of governmental response actions at uncontrolled hazardous waste sites and for the purpose of response actions incidental to the transportation of hazardous materials; and

Whereas, Proviso 9.51 of Act 397 of 2006 was incorrectly drawn to specify only interest accruing under Section 44-56-160(E) for these purposes. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Notwithstanding Proviso 9.51, Part IB of Act 397 of 2006, for fiscal year 2006-2007, all interest accruing on funds collected and held pursuant to Section 44-56-160 must be credited to the Hazardous Waste Contingency Fund and authorized for expenditure by the department to defray costs of governmental response actions at uncontrolled hazardous waste sites and for the purpose of response actions incidental to the transportation of hazardous materials.

SECTION    2.    This joint resolution takes effect upon approval by the Governor and applies retroactively to all interest accrued or accruing on funds collected pursuant to Section 44-56-160 beginning July 1, 2006.
