A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 58-35-105 SO AS TO PROVIDE THAT ALL ELECTRICAL UTILITY AND ELECTRIC COOPERATIVE POWER LINES CONSTRUCTED, INSTALLED, OR MODIFIED AFTER JULY 1, 2007, MUST BE LOCATED UNDER GROUND AND TO ALLOW THE LOCAL GOVERNMENT TO NEGOTIATE WITH THE APPROPRIATE UTILITY A FEE TO OFFSET THE COST OF BURYING THE POWER LINES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 35, Title 58 of the 1976 Code is amended by adding:

"Section 58-35-105.    After July 1, 2007, all electrical utility and electric cooperative power lines constructed, installed, or modified must be buried under ground at the request of the governing body of a local government having jurisdiction of the territory in which the electrical lines are constructed, installed, or modified. The governing body may negotiate a fee with the utility to offset the cost of burying the power lines."

SECTION    2.    This act takes effect upon approval by the Governor.
