A BILL

TO AMEND ACT 410 OF 2002, RELATING TO APPOINTMENTS FOR BOARDS AND COMMISSIONS FROM THE LEGISLATIVE DELEGATION REPRESENTING CHARLESTON COUNTY; SO AS TO PROVIDE FOR APPOINTMENTS AND RECOMMENDATIONS FOR APPOINTMENTS FOR OFFICES, BOARDS, AND COMMISSIONS PROVIDING WATER OR SEWER SERVICES TO A SERVICE AREA IN WHICH ONE OR MORE MUNICIPALITIES ARE LOCATED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1(B)(12) of Act 410 of     2002 is amended to read:

"(12)    any offices, boards, and commissions whose duties and responsibilities are totally within the boundaries of a municipality, which appointments must be made by the governing body of the municipality in which is located a majority of the customers served by that office, board, or commission providing water or sewer services to a service area in which one or more municipalities are located. Where sixty percent of such office, board, or commission's customers reside within a single municipality, the recommendations for appointment must be made by the governing body of the municipality. In all other cases, the recommendations for appointment must be made by the governing body of Charleston County as provided in Section 1(A)."

SECTION    2.    This act takes effect upon approval by the Governor.
