A BILL

TO PROVIDE A MINIMUM DISTANCE WITHIN WHICH A COMMERCIAL CONSTRUCTION, DEMOLITION, AND LAND-CLEARING LANDFILL IN YORK COUNTY MAY BE LOCATED FROM BUCKHORN CREEK AND TO PROVIDE EXCEPTIONS AND DEFINITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Notwithstanding another provision of law, a commercial construction, demolition, and land-clearing landfill in York County may not be located within two thousand feet of Buckhorn Creek. This section does not apply to existing permitted commercial construction, demolition, and land-clearing debris landfills. For purposes of this section, "commercial landfill" means a landfill providing landfill services to other persons or entities for compensation.

SECTION    2.    This act takes effect upon approval by the Governor.
