A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-1-1790 SO AS TO PROVIDE THAT A DEALER WHO SELLS MOPEDS MUST REGISTER WITH THE DEPARTMENT OF MOTOR VEHICLES BEFORE HE MAY SELL A MOPED IN THIS STATE, AND TO PROVIDE THAT THE DEPARTMENT SHALL ADOPT RULES AND PROMULGATE REGULATIONS TO ENSURE COMPLIANCE WITH THIS SECTION; AND TO AMEND SECTION 56-1-1710, RELATING TO THE DEFINITION OF THE TERM "MOPED", SO AS TO DELETE THE PROVISION THAT ESTABLISHES A MOPED'S MAXIMUM HORSEPOWER, AND TO INCREASE THE MAXIMUM SPEED THAT A MOPED MAY ATTAIN.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 9, Chapter 1, Title 56 of the 1976 Code is amended by adding:

"Section 56-1-1790.    For purposes of this article a dealer who sells a moped must register with the Department of Motor Vehicles before he may sell a moped in this State. The department shall adopt rules and promulgate regulations to ensure compliance with this section."

SECTION    2.    Section 56-1-1710 of the 1976 Code is amended to read:

"Section 56-1-1710.    For purposes of this article, 'moped' means a cycle with pedals to permit propulsion by human power or without pedals and with a motor of not more than fifty cubic centimeters which produces not to exceed two brake horsepower and which is not capable of propelling the vehicle at a speed in excess of thirty forty miles an hour on level ground. If an internal combustion engine is used, the moped must have a power drive system that functions directly or automatically without clutching or shifting by the operator after the drive system is engaged."

SECTION    3.    This act takes effect upon approval by the Governor.
