A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-7-74 SO AS TO PROVIDE THAT UNLESS APPROVED BY A TWO-THIRDS VOTE OF THE MEMBERSHIP OF EACH HOUSE OF THE GENERAL ASSEMBLY, APPROPRIATIONS MADE FOR RECURRING PURPOSES FROM NONRECURRING GENERAL FUND REVENUES FOR A FISCAL YEAR MAY NOT EXCEED ONE PERCENT OF THE TOTAL GENERAL FUND REVENUES ESTIMATED BY THE BOARD OF ECONOMIC ADVISORS TO BE AVAILABLE FOR THAT FISCAL YEAR AT THE TIME SUCH APPROPRIATIONS ARE MADE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 7, Title 2 of the 1976 Code is amended by adding:

"Section 2-7-74.    Unless approved by a two-thirds vote of the membership of each house of the General Assembly, appropriations made for recurring purposes from nonrecurring general fund revenues for a fiscal year may not exceed one percent of the total general fund revenues estimated by the Board of Economic Advisors to be available for that fiscal year at the time such appropriations are made. In regard to a general appropriations bill as it relates to the requirements of this section, the Office of State Budget shall certify compliance with the requirements of this section each time it certifies the general appropriations bill as being in balance in the manner required by law and rule."

SECTION    2.    This act takes effect upon approval by the Governor.
