A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-217 SO AS TO PROHIBIT AN AUTOMOBILE INSURANCE COMPANY FROM LIMITING OR EXCLUDING BODILY INJURY, UNINSURED MOTORIST, OR UNDERINSURED COVERAGE, OTHERWISE AFFORDED UNDER A POLICY BECAUSE OF A FAMILY RELATIONSHIP BETWEEN A CLAIMANT AND THE INSURED, REGARDLESS OF WHETHER THE COVERAGE IS MANDATORY OR VOLUNTARY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 3, Chapter 77, Title 38 of the 1976 Code is amended by adding:

"Section 38-77-217.    A provision of an automobile insurance policy that attempts to or has the effect of limiting or excluding bodily injury liability insurance, uninsured motorists insurance, or underinsured motorists insurance coverage, otherwise afforded under the policy because of a family relationship between the claimant and the insured, is contrary to the public policy of this State and is prohibited regardless of whether the bodily injury liability insurance, uninsured motorists insurance, or underinsured motorists insurance coverage is mandatory or voluntary."

SECTION    2.    This act takes effect upon approval by the Governor.
