A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-11-495, SO AS TO AUTHORIZE THE STATE BUDGET OFFICE OF THE BUDGET AND CONTROL BOARD TO CONDUCT A SURVEY TO DETERMINE ALL THE CONTRACTS AND GRANTS ADMINISTERED BY STATE AGENCIES AND TO PROVIDE A SEARCHABLE WEBSITE LISTING ALL SUCH CONTRACTS AND GRANTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.     The 1976 Code is amended by adding:

"Section 1-11-495.    (A)    The State Budget Office of the Budget and Control Board shall conduct a survey to determine all contracts and grants programs offered through state agencies, and to learn whether information about the contracts and grants programs are available on a website. This information shall include: (1) descriptions about the programs; (2) the amounts awarded; and (3) the actual contract language as authorized pursuant to the South Carolina Freedom of Information Act, Title 30, Chapter 4.

(B)    The State Budget Office of the Budget and Control Board must provide a method for compiling, accessing, and updating information about all contracts and grants programs through a single searchable website, accessible by the public at no cost, that must include:

(1)    the name of the entity receiving the award;

(2)    information on the award, including transaction type, funding agency, program source, and an award title descriptive of the purpose of each funding action;

(3)    the location of the entity receiving the award and the primary location of performance under the award, including the county, municipality, district, or other political subdivision;

(4)    a unique identifier of the entity receiving the award and of the parent entity of the recipient, should the entity be owned by another entity; and

(5)    any other relevant information specified by the State Budget Office.

(C)    State agencies shall comply with the instructions and guidance issued by the Budget and Control Board, and shall provide appropriate assistance to the Budget and Control Board upon request, so as to assist the Budget and Control Board in ensuring the existence and operation of a single website.

(D)    The website must be updated no later than thirty days after the award of any state award requiring a posting.

(E)    Nothing in this section shall require the disclosure of classified information."

SECTION    2.    This act takes effect upon approval by the Governor.
