A JOINT RESOLUTION

TO PROVIDE THAT A LOCAL SCHOOL DISTRICT MAY PAY TEACHERS BASED ON THE EDUCATION LEVEL AND YEARS OF EXPERIENCE THE TEACHERS POSSESSED IN FISCAL YEAR 2009-2010 WITHOUT NEGATIVE IMPACT TO THEIR EXPERIENCE CREDIT, TO PROVIDE VOTING AND NOTICE REQUIREMENTS FOR THIS DECISION, TO REQUIRE THAT PAYMENT ACCORDING TO THE 2009-2010 DATA BE APPLIED UNIFORMLY, TO PROVIDE THAT A LOCAL SCHOOL DISTRICT MAY NOT PAY DISTRICT OR SCHOOL ADMINISTRATORS MORE THAN THEY RECEIVED IN FISCAL YEAR 2009-2010, AND TO DEFINE CERTAIN TERMS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.        A.        For Fiscal Year 2010-2011, a local school district board of trustees may determine that all teachers employed by the district must be paid based on their educational level and the years of experience on the school district salary schedule they possessed in Fiscal Year 2009-2010, without a negative impact resulting to their experience credit. This decision must be voted on by the local school district board of trustees in a public school board meeting with public notice posted on the school district website.

B.        Application of this provision must be applied uniformly for all teachers within the school district. The local school district board of trustees may not provide for an increase in salary for district administrators and school administrators and their compensation may not be higher than the actual amount received in Fiscal Year 2009-2010.

C.        For purposes of this joint resolution, district administrators and school administrators are defined by the Department of Education using the Professional Certified Staff (PCS) System. For individuals not coded in PCS, the determination must be based upon whether the individual performs the functions outlined in position codes identified by the department as administration.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
