A BILL

TO AMEND SECTION 1-11-720, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ENTITIES WHOSE EMPLOYEES AND RETIREES ARE ELIGIBLE FOR COVERAGE UNDER THE STATE HEALTH AND DENTAL INSURANCE PLANS, SO AS TO ALLOW A PERSON WHO IS ELIGIBLE TO PARTICIPATE IN THE STATE HEALTH AND DENTAL INSURANCE PLANS AS A COUNTY COUNCIL MEMBER OF A PARTICIPATING COUNTY, AND WHO IS ALSO ELIGIBLE TO ELECT COVERAGE AS THE SPOUSE OF A COVERED EMPLOYEE OR RETIREE, TO PARTICIPATE IN THE INSURANCE PLANS AS EITHER AN EMPLOYEE OR A SPOUSE, BUT NOT BOTH.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1-11-720 of the 1976 Code, as last amended by Act 353 of 2008, is further amended by adding at the end to read:

"(D)    A person who is eligible to participate in the state health and dental insurance plans under this section as a council member of a participating county and who is also eligible to participate as the spouse of a covered employee or retiree may choose to participate in the insurance plans as either an employee or a spouse, but not both."

SECTION    2.    This act takes effect upon approval by the Governor.
