A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 46-13-250 SO AS TO PROVIDE THAT A COMMERCIAL APPLICATOR OF PESTICIDES IS NOT REQUIRED TO BE CERTIFIED TO PURCHASE AND APPLY ANY PESTICIDE THAT IS AVAILABLE TO CONSUMERS AT A RETAIL ESTABLISHMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 13, Title 46 of the 1976 Code is amended by adding:

"Section 46-13-250.    Notwithstanding any other provision of this chapter or any other provision of law or regulation, a person who otherwise may be considered a commercial applicator is not required to be certified under this chapter to purchase and apply any pesticide that is available to consumers at a retail establishment."

SECTION    2.    This act takes effect upon approval by the Governor.
