A BILL

TO AMEND SECTION 37, PART IB OF ACT 291 OF 2010, AN ACT TO MAKE APPROPRIATIONS AND TO PROVIDE REVENUES TO MEET THE ORDINARY EXPENSES OF STATE GOVERNMENT FOR THE FISCAL YEAR BEGINNING JULY 1, 2010, BY ADDING SECTION 37.19 TO PROVIDE THAT WATER RECREATIONAL RESOURCE FUNDS APPORTIONED AMONG THE COUNTIES SHALL BE TRANSFERRED TO THE SCHOOL DISTRICTS OF THE COUNTIES, AND TO PROVIDE THAT OF MONIES ACCUMULATED IN THE STATE WATER RECREATION FUND NOT YET APPROPRIATED TO THE COUNTIES, FIFTY PERCENT SHALL BE TRANSFERRED TO THE COUNTIES AND TRANSFERRED TO THE SCHOOL DISTRICTS OF THE COUNTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 37, Part IB of Act 291 of 2010 is amended by adding:

"37.19    (DNR: Water Recreational Funds Transferred) Notwithstanding any provision of this act or any law to the contrary:

The State Treasurer shall transfer the unexpended balance from any county that has received a disbursement from the Water Recreational Resource Fund to the school district or districts located in the county. If a county contains more than one school district, the treasurer shall transfer a portion of the funds to each district based on that district's percentage of the total student population of the county.

The State Treasurer shall apportion amongst the counties fifty percent of the balance of the state Water Recreation Resource Fund in the manner provided in Section 12-28-2730 and shall transfer the apportioned amount to the school district or districts located in the county. If a county contains more than one school district, the treasurer shall transfer a portion of the funds to each district based on that district's percentage of the total student population of the county.

The Department of Natural Resources may present a written justification to the House of Representatives Ways and Means Committee and the Senate Finance Committee seeking to have all or part of the transferred funds restored to the Water Recreation Resource Fund. If the House Ways and Means Committee and the Senate Finance Committee jointly recommend, after public evaluation of the department's request, that the transferred funds be restored in whole or part to the Water Recreation Resource Fund, the General Assembly may provide that the funds be restored and disbursed to the counties in the manner provided in Section 12-28-2730."

SECTION    2.    This act takes effect upon approval by the Governor.
