A BILL

TO AMEND SECTION 56-5-1810, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXCEPTIONS TO THE REQUIREMENT THAT A VEHICLE MUST BE DRIVEN ON THE RIGHT HALF OF A ROADWAY, SO AS TO PROVIDE WHEN PASSING A PEDESTRIAN, BICYCLE, TRACTOR, GOLF CART, OR ANOTHER SLOW-MOVING VEHICLE, THE OPERATOR OF A VEHICLE MAY DRIVE TO THE LEFT OF THE CENTER OF A ROADWAY, TO PROVIDE AN ADDITIONAL CIRCUMSTANCE WHEN A PERSON SHALL YIELD THE RIGHT-OF-WAY TO OTHER VEHICLES, AND TO MAKE A TECHNICAL CHANGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 56-5-1810(a)2. of the 1976 Code is amended to read:

    "2.    When an obstruction exists making it necessary to drive to the left of the center of the highway roadway, or when passing a pedestrian, bicycle, tractor, golf cart, or another slow-moving vehicle, the operator of a vehicle may drive to the left of the center of a roadway. Any person so doing shall yield the right-of-way to all vehicles traveling in the proper direction upon the unobstructed portion or opposite direction of the highway roadway within such distance so as not to constitute an immediate hazard."

SECTION    2.    This act takes effect upon approval by the Governor.
