STATEMENT OF ESTIMATED FISCAL IMPACT

Explanation of Fiscal Impact

State Expenditure

This bill would add surgically implanted drug delivery systems to the exception list of prescriptions for controlled substances in Schedule II that may exceed 31 days. Currently, prescriptions for controlled substances in Schedule II, with the exception of transdermal patches, may not exceed 31 days.

Department of Health and Environmental Control. DHEC is responsible for enforcing the laws and regulations pertaining to controlled substances including prescription drugs. This bill would create a new exception of prescriptions for controlled substances in Schedule II that may exceed 31 days. DHEC anticipates they will be able to enforce the provisions of this bill using existing appropriations and staff. Therefore, this bill will not have an expenditure impact on the general funds, federal funds, or other funds of the department.

A BILL

TO AMEND SECTION 44-53-360, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PRESCRIPTIONS, SO AS TO EXEMPT SURGICALLY IMPLANTED DRUG DELIVERY SYSTEMS FROM THE THIRTY-ONE DAY SUPPLY LIMITATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-53-360(e) of the 1976 Code is amended to read:

"(e)    Prescriptions for controlled substances in Schedule II with the exception of transdermal patches and surgically implanted drug delivery systems, must not exceed a thirty-one day supply. Prescriptions for Schedule II substances must be dispensed within ninety days of the date of issue, after which time they are void. Prescriptions for controlled substances in Schedules III through V, inclusive, must not exceed a ninety-day supply."

SECTION    2.    This act takes effect upon approval by the Governor.
