S 0953 General Bill, By Giese and S.S. Martschink
    A Bill to amend Section 61-9-40, Code of Laws of South Carolina, 1976, relating to the unlawful sale of beer or wine to a person under twenty-one years of age, and Section 61-13-290, relating to the unlawful sale of alcoholic liquor to a person under twenty-one years of age, so as to provide that a person authorized to sell these products is not considered to have violated the provisions of the above Sections if the purchaser knowingly misrepresents his age by producing false identification; to amend Section 61-9-70, relating to the penalties for the violation of certain provisions of law relating to the unlawful purchase of beer and wine and Section 20-7-380, relating to unlawful purchase of alcoholic liquor, so as also to require the suspension for a period of ninety days of the person's South Carolina driver's license or the permanent revocation of his nonresident operator's permit where false information as to the purchaser's age was presented; and to provide that certain actions under these Sections do not constitute prima facie evidence of violations of the Sections but rather that it is permissible to infer that violations of the Sections.
