AN ACT TO AMEND ACT 172 OF 1969, RELATING TO THE
NORTH SPARTANBURG AREA FIRE AND RESCUE DISTRICT
BOARD OF FIRE AND RESCUE CONTROL, SO AS TO INCREASE
THE MEMBERS ON THE BOARD FROM FIVE TO SEVEN AND TO
PROVIDE FOR TERMS OF FOUR RATHER THAN SIX YEARS.
Be it enacted by the General Assembly of the State of South
Carolina:
Membership and terms revised
SECTION 1. Section 2 of Act 172 of 1969 is amended to read:
"Section 2. There is established a board of fire and rescue
control for the North Spartanburg Area Fire and Rescue District to be
composed of seven members who must be appointed by the Governor
upon the recommendation of a majority of the Spartanburg County
Legislative Delegation. Members shall serve for terms of four years and
until their successors are appointed and qualify. The members of the
board shall serve without pay and shall file annually a report with the
Spartanburg County Board of Control not later than the first of
November of each year showing all activities and disbursements made by
the board during the year.
If at least twenty percent of the qualified electors residing in the
district petition the commissioners of election by the first of September
of a general election year, the commissioners shall call an election to be
held at the following general election for the purpose of electing a
member to the board to succeed the member whose term expires during
that year, for a four-year term. Thereafter, members must be elected in
each succeeding general election for terms of four years."
Transition provisions
SECTION 2. Members of the Board of Fire and Rescue of the North
Spartanburg Area Fire and Rescue District serving on this act's effective
date shall continue to serve until their terms expire. Additional members
elected to the board pursuant to this act and subsequent members elected
shall serve terms of four years as provided for in this act.
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
