AN ACT TO DEVOLVE THE AUTHORITY TO LEVY TAXES
FOR SCHOOL OPERATING EXPENSES FROM THE GOVERNING
BODY OF LANCASTER COUNTY TO THE LANCASTER COUNTY
SCHOOL DISTRICT, TO PROVIDE A LIMITATION, AND TO
PROVIDE FOR A REFERENDUM TO EXCEED THE LIMITATION.
Be it enacted by the General Assembly of the State of South Carolina:
Devolution of taxing authority
SECTION 1. (A) The authority to levy taxes for school operating
expenses is devolved from the governing body of Lancaster County to the
Lancaster County School District.
(B) This levy may not be increased more than five mills in a year over
that amount levied for the preceding year without the approval of the
qualified electors of the district in a referendum. If the levy is within the
limits authorized by this act, the county auditor shall levy and the
treasurer shall collect the millage specified.
(C) This referendum must be ordered by the board of trustees of the
district.
(D) Notice of the referendum must be given in a newspaper of general
circulation in the district at least one week for two consecutive weeks
before the referendum. The notice must give the date of the referendum
and the question on which to be voted.
(E) A referendum conducted pursuant to the provisions of this act may
not be held later than the thirty-first day of July.
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
