A BILL

TO AMEND SECTION 48-23-260, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SHARING OF REVENUE BY COUNTIES CONTAINING STATE FOREST LANDS, SO AS TO INCLUDE LANDS OWNED BY A STATE AGENCY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 48-23-260 of the 1976 Code is amended to read:

"Section 48-23-260. The State Treasurer shall pay to any a county containing state forest lands or lands owned by a state agency an amount equal to twenty-five per cent of the gross proceeds received by the State in each fiscal year from the sale of timber, pulpwood, poles, gravel, land rentals, and other privileges on such State forest the lands in any such county. This provision shall apply section applies to all state forest lands managed or operated by the State Commission of Forestry whether they be owned in fee by the State or leased from the United States, but this provision shall it does not apply to state parks. The funds herein provided for shall in this section must be spent for general school purposes. Where a particular State forest lies land is in more than one county or school district, the funds derived from such State forest and to be paid by the State Treasurer shall must be apportioned on the basis of land acreage involved. All funds Funds distributed under the provisions of this section shall must be spent upon the approval of a majority of the county legislative delegation, including the Senator."

SECTION 2. This act takes effect upon approval by the Governor.
