TO AMEND CHAPTER 67, TITLE 15 OF THE 1976 CODE, RELATING TO THE RECOVERY OF REAL PROPERTY, BY ADDING ARTICLE 4 TO ABOLISH THE DOCTRINE OF ADVERSE POSSESSION; AND TO REPEAL SECTIONS 15-67-210 THROUGH SECTION 15-67-260 AND ARTICLE 3, CHAPTER 3 OF TITLE 15.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 67, Title 15 of the 1976 Code is amended by adding:

"ARTICLE    4

ADVERSE POSSESSION

Section 15-67-280.        The statutory and common law doctrine of adverse possession as a method of obtaining title to real property by exercising continuous, open, actual, notorious, and exclusive possession of the property for a specified period of time is abolished."

SECTION    2.    Sections 15-67-210 through Section 15-67-260 of Title 15 of the 1976 Code are repealed.

SECTION    3.    Article 3, Chapter 3, Title 15 of the 1976 Code is repealed.

SECTION    4.    This act takes effect upon approval by the Governor.
