CHAPTER 119.

University of South Carolina

(Statutory Authority: 1976 Code Sections 56-21-10 to 56-21-60)

ARTICLE 1

General RegulationsNext

119-1 Definitions.

The definitions and meaning of terms shall be as follows:

A. Academic Year. From opening date of one school calendar year to same date of the ensuing calendar year.

B. University. All property which is owned, leased, supervised or otherwise controlled by the University of South Carolina.

C. Campus. Unless otherwise provided, the following campuses of the University of South Carolina System: USC-Aiken; USC-Columbia; Coastal Carolina College, Conway; USC-Spartanburg; USC-Sumter; and USC-Union.

119-2 To Whom PreviousRegulationsNext Apply.

These PreviousregulationsNext apply to the drivers of all vehicles, whether public or private, and are in force twenty-four (24) hours a day unless otherwise provided. It is unlawful for any driver to violate any of the provisions of these PreviousregulationsNext, except as otherwise permitted by these PreviousregulationsNext, by the laws of the State of South Carolina, or by the respective campus parking policies.

119-3 Traffic Signs.

(a) The driver of any vehicle shall obey the lawful instruction of any campus public safety officer, and of any official traffic sign properly placed in accordance with the provisions of these PreviousregulationsNext except when otherwise directed by a safety officer. Whenever a particular section of these PreviousregulationsNext does not state that signs are required, such section is effective without signs being provided.

(b) The appropriate campus official responsible for law enforcement and public safety as appointed by the President, Chancellors or Deans of the respective campuses, shall have the authority to cause the signs, signals, and markings necessary to implement these PreviousregulationsNext to be erected, established, and maintained.

119-4 Altering or Defacing of Traffic Signs.

No person shall, without lawful authority, attempt to or in fact alter, deface, injure, knock down, or remove any official traffic sign or device, or any inscription, shield or insignia thereon, or any other part thereof.

119-5 Authority of President.

The President, Chancellors or Deans of the respective campuses, acting pursuant to the authority vested in them by these PreviousregulationsNext, shall exercise their discretion and authority in such a manner as to insure the proper conduct of the necessary business of the University and effective utilization and control of the available parking areas and facilities on the campuses of the University for the benefit and maximum convenience of students, faculty, staff members, and visitors.

119-6 Liability for Protection of Motor Vehicles.

The University shall assume no responsibility for the care and/or protection of any vehicle or its contents at any time when it is operated or parked on the University.

ARTICLE 2

University Motor Vehicle Registration

119-7 Motor Vehicle Registration.

The appropriate campus office for motor vehicle registration as designated by the President, Chancellors Deans of the respective campuses, is hereby authorized to be responsible for registration of vehicles, keeping registration cards, issuance of permits, and recording and reporting violations.

119-8 Registration of Students' Vehicles.

Any student who shall regularly or occasionally drive, operate or control, park, let stand, or otherwise use or maintain a motor vehicle or bicycle on the land or properties of the University is required to register the vehicle with the appropriate campus office for motor vehicle registration. This registration shall be equally applicable to the spouse or husband of a student. A permit will be issued to the student upon proper registration and fee. Permits shall be displayed on the left side (driver's side) of the rear bumper.

119-9 Faculty and Staff Parking Permits.

Every faculty or Staff member of the University who owns or operates a vehicle on campus may acquire a permit to park a vehicle in a designated parking area. The Faculty and Staff member who is issued a parking permit is responsible for all violations against the vehicle for which the permit is issued.

119-10 Registration Fees.

Registration fees are established by the System Vice President for Law Enforcement and Safety for USC-Columbia campus, the Chancellors for the campuses at USC-Aiken; Coastal Carolina College, Conway; and USC-Spartanburg and the Deans of the campuses at USC-Sumter and USC-Union subject to the approval of the President.

ARTICLE 3

Parking Areas

119-11 Traffic and Parking Instructions.

University of South Carolina traffic and parking instructions are indicated by (a) printed policies and guides, (b) campus maps and (c) signs, street or curb markings.

119-12 Meter Charges.

Meter charges are established by the System Vice President for Law Enforcement and Safety for the USC-Columbia campus, the Chancellors of the campuses at USC-Aiken; Coastal Carolina College, Conway; and USC-Spartanburg, and the Deans of the campuses at USC-Sumter and USC-Union subject to approval of the President. Neither registration nor decals are required for use of metered spaces.

119-13 Parking Garages and Fees.

Faculty, Staff and Students may obtain parking space in available parking garages on the Columbia campus from the appropriate campus office for motor vehicle registration. Garage fees are established by the System Vice President for Law Enforcement and Safety subject to approval of the President.

ARTICLE 4

Violations, Penalties and Bonds

119-14 Responsibility for Violations.

The driver and owner or person in whose name a vehicle is registered shall be responsible for all violations incurred by the vehicles.

119-15 Payment of Penalties and Bonds.

Penalties and/or bonds are payable in person or by mail at the appropriate campus office for motor vehicle registration in accordance with Sections 119-17, 119-18, and 119-19 below.

119-17 Delinquent Violations-Increase in Bonds.

(a) USC-Columbia

For Delinquent violations neither paid nor appealed after the third school day from the date of issuance-the bond will be increased as prescribed below:

(a) $2.00 Bond Increased to $5.00

(b) $3.00 Bond Increased to $6.00

(c) $5.00 Bond Increased to $8.00

(d) $10.00 Bond Increased to $13.00

(e) $15.00 Bond Increased to $18.00

(f) $100.00 Bond Increased to $103.00

(b) USC-Aiken; Coastal Carolina College, Conway; and USC-Spartanburg.

(a) $1.00 Bond Increased to $2.00

(b) $3.00 Bond Increased to $5.00

(c) $5.00 Bond Increased to $7.00

(d) $10.00 Bond Increased to $12.00

(e) $15.00 Bond Increased to $17.00

(f) $100.00 Bond Increased to $102.00

(c) USC-Sumter and USC-Union

For delinquent violations not paid or appealed after the third day from the date of issuance at the University of South Carolina-Sumter and Union, the fine will be doubled. If delinquent violations are not resolved by the end of the term during which the violation was issued, the fine will increase to $10.00, except in instances where original fine is more than $10.00.

119-18 Increase in Bonds After Service of Warrant.

(a) USC-Columbia.

Warrants may be served after 30 days of notification to registered owner. Bonds may increase as follows:

(a) $5.00 Bond Increased to $8.00

(b) $6.00 Bond Increased to $9.00

(c) $8.00 Bond Increased to $11.00

(d) $13.00 Bond Increased to $16.00

(e) $18.00 Bond Increased to $21.00

(f) $03.00 Bond Increased to $106.00

(b) USC-Aiken; Coastal Carolina College, Conway; and USC-Spartanburg.

(a) $2.00 Bond Increased to $5.00

(b) $5.00 Bond Increased to $8.00

(c) $7.00 Bond Increased to $10.00

(d) $12.00 Bond Increased to $16.00

(e) $17.00 Bond Increased to $20.00

119-19 Depositing of Substitute for a Coin in a Meter.

It shall be unlawful to deposit or cause to be deposited in any meter, any slug, device or metallic substitute for a coin of the United States. This constitutes a misdemeanor triable by a magistrate.

ARTICLE 5

Speed Limits

119-20 Campus Speed Limit.

(a) USC-Aiken; USC-Columbia; Coastal Carolina College, Conway.

Unless otherwise posted, the campus speed limit is 15 miles per hour.

(b) USC-Sumter and USC-Union.

The campus speed limit on the campus of USC-Sumter and USC-Union is 10 miles per hour.

(c) USC-Spartanburg.

Unless otherwise posted, the campus speed limit is 25 miles per hour.

ARTICLE 6

Vehicle Towing and Impounding

119-21 When Vehicle May Be Towed or Impounded.

The appropriate campus official responsible for law enforcement and public safety or his designate shall have the power to have a vehicle impounded, towed and stored at the owner's expense and risk under the following conditions:

A. If the motor vehicle is parked in a fire lane.

B. If the motor vehicle is parked in a handicapped space without benefit of a handicapped permit or is parked in such a way as to block a curb cut for the handicapped.

C. If the motor vehicle is parked in such a way as to block a driveway, to block a service entrance, parked on yellow curb or to create a hazard to safety.

D. If the motor vehicle is parked in a parking-by-permit-only space without benefit of a permit.

E. If three or more unpaid traffic violations have been issued against said vehicle.

ARTICLE 7

Boards, Committees and Courts

119-22 Appointment of Boards, Committees and Courts.

The President of the USC-Columbia campus, the Chancellors of the USC-Aiken; Coastal Carolina College, Conway; and USC-Spartanburg campuses, and the Deans of the USC-Sumter and USC-Union campus shall have the authority to appoint such persons, Boards, Committees and Administrative Bodies as he/she deems necessary to hear appeals and to assist in the administration of the rules and Previousregulations contained herein.

ARTICLE 8

Summons

119-23 Who May Issue Summons or Citations.

The appropriate campus official responsible for law enforcement and safety or his designate is authorized to issue summons and/or other traffic citations pursuant to authority contained in Sections 56-21-10 to 56-21-60 of the 1976 Code.
