TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-1-550 SO AS TO PROVIDE THAT THE DEPARTMENT OF MOTOR VEHICLES MAY ISSUE SPECIAL ROUTE RESTRICTED DRIVER'S LICENSES TO PERSONS WHOSE DRIVER'S LICENSES HAVE BEEN SUSPENDED FOR OPERATING UNINSURED MOTOR VEHICLES, OR FOR FAILING TO COMPLY WITH TRAFFIC CITATIONS OR DEPARTMENT OF NATURAL RESOURCES SUMMONSES FOR LITTERING VIOLATIONS, TO PROVIDE A FEE FOR ITS ISSUANCE, TO PROVIDE FOR THE DISTRIBUTION OF THE FEE, AND TO PROVIDE PENALTIES FOR THE OPERATION OF A MOTOR VEHICLE OUTSIDE THE RESTRICTIONS IMPOSED BY THESE DRIVER'S LICENSES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 1, Title 56 of the 1976 Code is amended by adding:

"Section 56-1-550.    (A)    A person whose driver's license is initially suspended pursuant to Section 56-10-240 or 56-25-20 and who is subsequently suspended under Section 56-1-460 may apply for a special restricted driver's license at any time during the subsequent suspension if the person has satisfied all requirements for reinstatement of the initial suspension and is employed or enrolled in a college or universityNext. This special restricted driver's license shall permit him to drive only to and from work or his place of education and in the course of his employment or education during the period of suspension. The department may issue the special restricted driver's license only upon a showing by the person that he is employed or enrolled in a college or Previousuniversity, and that he lives further than one mile from his place of employment or place of education.

(B)    If the department issues a special restricted driver's license, it shall designate reasonable restrictions on the times during which and routes on which the person may operate a motor vehicle. A change in the employment hours, place of employment, status as a student, or residence must be reported immediately to the department by the licensee.

(C)    The fee for each special restricted driver's license is one hundred dollars, but no additional fee is due because of changes in the place and hours of employment, education, or residence. Of this fee, eighty dollars must be placed by the Comptroller General into a special restricted account to be used by the Department of Motor Vehicles to defray the expenses of the department. The remainder of the fees collected pursuant to this section must be credited to the Department of Transportation State Non-Federal Aid Highway Fund.

(D)    The operation of a motor vehicle outside the time limits and route imposed by a special restricted license by the person issued that license is a violation of Section 56-1-460."

SECTION    2.    This act takes effect upon approval by the Governor.
