AN ACT TO PROVIDE FOR THE FISCAL AUTONOMY OF THE
SEVEN LOCAL SCHOOL DISTRICTS IN SPARTANBURG
COUNTY; TO PROVIDE FOR THE POWERS OF THE COUNTY
BOARD OF EDUCATION OF SPARTANBURG COUNTY; TO
PROVIDE FOR THE OPERATIONAL BUDGET OF THE COUNTY
BOARD OF EDUCATION OF SPARTANBURG COUNTY; TO
PROVIDE FOR THE EQUITABLE DISTRIBUTION OF ASSETS OF
THE COUNTY BOARD OF EDUCATION OF SPARTANBURG
COUNTY; TO PROVIDE FOR THE COUNTY BOARD'S MEETINGS;
AND TO REPEAL ACT 610 OF 1994, RELATING TO THE
ABOLITION OF THE COUNTY BOARD OF EDUCATION OF
SPARTANBURG COUNTY.
Be it enacted by the General Assembly of the State of South
Carolina:
Boards of trustees vested with fiscal autonomy
SECTION 1. Each of the seven boards of trustees of the school districts
within Spartanburg County are vested and allocated with total fiscal
autonomy.
Powers of County Board of Education; etc.
SECTION 2. The County Board of Education of Spartanburg County is
empowered to:
(A) ensure that the minimum foundation program money is distributed
to the seven Spartanburg County school districts on a fair and equitable
basis, based on the prevailing funding formula utilized during the
1993-94 school year for the distribution of minimum foundation
funds;
(B) ensure that for school districts within the county to receive funds
from the minimum foundation program they must maintain a common
teacher salary schedule throughout the seven school districts of the
county;
(C) employ a secretary to the County Board of Education of
Spartanburg County for the purpose of performing the administrative
functions of the board. If a secretary of the board is employed, the
secretary's office must be maintained within the space provided free of
charge by one of the seven local school districts. The secretary's salary
must be derived and paid from the county board's operational budget.
All other powers, if any, formerly possessed by the County Board of
Education of Spartanburg County are devolved, and otherwise allocated,
upon the seven boards of trustees of the local districts of Spartanburg
County.
Budget for County Board of Education
SECTION 3. The operational budget for the County Board of Education
of Spartanburg County must be derived from the minimum foundation
funds and shall not exceed one-half of one percent of the previous year's
total minimum foundation funds for the county.
Meetings of County Board of Education
SECTION 4. The County Board of Education of Spartanburg County
shall conduct its meetings in a place that must be provided by one of the
seven local school districts of the county.
Sale of assets; distribution of proceeds; etc.
SECTION 5. All assets of the County Board of Education of
Spartanburg County must be sold and the proceeds from the sale of
assets must be distributed equally to the local seven school districts based
upon an average daily attendance in each of the seven school districts in
Spartanburg County. The sale and distribution must be accomplished
expeditiously. In no event shall the sale and distribution of the proceeds
occur twelve months later than the effective date of this act unless
otherwise approved by the Spartanburg County Legislative Delegation.
The sale of the assets must be conducted by the County Board of
Education of Spartanburg County in accordance with the procedures
prescribed by current state law and the South Carolina Consolidated
Procurement Code.
Repeal
SECTION 6. Act 610 of 1994 is repealed.
Time effective
SECTION 7. This act takes effect upon approval by the Governor.
