TO PROHIBIT A PHYSICIAN WHO RECEIVES PAYMENT UNDER A SUPPLEMENTAL PROGRAM OF COVERAGE TO MEDICARE, OR OTHER GOVERNMENTAL PROGRAM, FROM CHARGING TO OR COLLECTING FROM A SUBSCRIBER OR A COVERED DEPENDENT OF A SUBSCRIBER AN AMOUNT IN EXCESS OF THE REASONABLE CHARGE FOR THE SERVICE PROVIDED AS DETERMINED BY THE UNITED STATES SECRETARY OF HEALTH AND HUMAN SERVICES, TO DEFINE "SUBSCRIBER" FOR PURPOSES OF THIS ACT, AND TO PROVIDE A PENALTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) No physician licensed and practicing medicine according to the laws of this State who receives payment under a supplemental program of coverage to medicare, or other governmental program, may charge to or collect from a subscriber or a covered dependent of a subscriber an amount in excess of the reasonable charge for the service provided, as determined by the United States Secretary of Health and Human Services. For the purposes of this subsection, a "subscriber" is a person who is eligible for benefits supplemental to Part B of Title XVIII of the Social Security Act, as amended, under a nongroup medical service agreement or a subscription certificate issued under a nongroup medical service agreement or under a group medical service agreement and who is entitled to the benefits provided pursuant to these agreements or certificate, including payments for the services of a participating or nonparticipating physician to be made by a medical service corporation to the subscriber or to the physician as these payments are made for the services under Part B of Title XVIII of the Social Security Act, as amended.
(B) A person who violates the provisions of subsection (A) is guilty of a misdemeanor and, upon conviction, must be punished by a fine of five hundred dollars for each separate violation.
SECTION 2. This act takes effect upon approval by the Governor.
