A BILL

TO AMEND SECTION 27-37-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SERVICE OF A RULE TO SHOW CAUSE WHY A TENANT SHOULD NOT BE EJECTED FROM A RENTED PREMISES, SO AS TO DELETE THE REQUIREMENT THAT THE PREMISES REMAIN UNOCCUPIED FOR FIFTEEN DAYS BEFORE A COPY OF THE RULE IS SERVED BY LEAVING IT AFFIXED TO THE MOST CONSPICUOUS PART OF THE PREMISES AND TO PROVIDE FOR A WARRANT OF EJECTMENT TO BE SERVED IN THE SAME MANNER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 27-37-30 of the 1976 Code is amended to read:

"Section 27-37-30. The A copy of such the rule provided in Section 27-37-20 and the warrant provided in Section 27-37-40 may be served in the same manner as is provided by law for the service of the summons in actions pending in the court of common pleas of this State or, when no person can be found in possession of the premises and the premises shall have remained unoccupied for a space of fifteen days or more immediately prior to the date of such service, the copy of such rule may be served, by leaving it affixed to the most conspicuous part of the premises."

SECTION 2. This act takes effect upon approval by the Governor.
