A BILL

TO AMEND SECTION 23-1-60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO APPOINTMENT, COMPENSATION, REMOVAL, AND TERMS OF SPECIAL DEPUTIES, CONSTABLES, SECURITY GUARDS, AND DETECTIVES, SO AS TO PROVIDE THAT A RETIRED POLICE OFFICER OR LAW ENFORCEMENT OFFICER IN THIS STATE IS EXEMPT FROM THIS SECTION AND UPON APPLICATION MUST BE APPOINTED AS A CONSTABLE UNLESS HE WAS NOT IN GOOD STANDING UPON RETIREMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 23-1-60 of the 1976 Code is amended to read:

"Section 23-1-60. (A) The Governor may, at his discretion, may appoint such additional deputies, constables, security guards, and detectives as he may deem considers necessary to assist in the detection of crime and the enforcement of any the criminal laws of this State, the. The qualifications, salaries, and expenses of such the deputies, constables, security guards, and detectives appointed to under this section must be determined by and paid as provided for by law. These appointments by the Governor may be made hereunder without compensation from the State. Any appointments Appointments of deputies, constables, security guards, and detectives made without compensation from the State may be revoked by the Governor at his pleasure. All appointments of deputies, constables, security guards and detectives hereunder without compensation shall and expire sixty days after the expiration of the term of the Governor making such the appointment. Each Governor shall reappoint all deputies, constables, security guards, and detectives who are regularly salaried as provided for by law within sixty days after taking office unless such the deputy, constable, security guard, or detective is discharged with cause as provided for by law. All persons appointed under the provisions of this section shall must be required to furnish evidence that they are knowledgeable as to the duties and responsibilities of a law enforcement officer or shall must be required to take such training in this field as may be prescribed by the chief of the South Carolina Law Enforcement Division.

(B) A retired police officer or law enforcement officer of a jurisdiction in this State who applies for appointment as a constable is exempt from the provisions of subsection (A) and must be granted the appointment unless the police officer or law enforcement officer was not in good standing at the time of his retirement."

SECTION 2. This act takes effect upon approval by the Governor.
