TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-15-265 SO AS TO PROVIDE THAT NO MOTION PICTURE VIDEO MAY BE RENTED OR SOLD IN THIS STATE WHICH HAS NOT BEEN RATED BY THE MOTION PICTURE ASSOCIATION OF AMERICA OR OTHER SIMILAR INDUSTRY RATING ORGANIZATION, TO PROVIDE THAT ANY MOTION PICTURE VIDEO NOT RATED FOR GENERAL AUDIENCES MUST ALSO HAVE A STATEMENT ATTACHED TO ITS CONTAINER EXPLAINING THE REASON FOR ITS NOT BEING RATED FOR GENERAL AUDIENCES, AND TO PROVIDE PENALTIES FOR VIOLATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-15-265. No motion picture video may be rented or sold in this State which has not been rated by the Motion Picture Association of America or other similar industry rating organization. The rating must be shown on the container of the video and be plainly visible to any person considering renting or purchasing the video. Any motion picture video not rated for general audiences must also have a statement attached to its container explaining the reason for its not being rated for general audiences.
Any person violating the provisions of this section is guilty of a misdemeanor and upon conviction for a first offense must be fined not more than two hundred dollars or imprisoned for not more than thirty days and for a second or subsequent offense must be fined not more than five hundred dollars or imprisoned for not more than sixty days. Each violation of this section constitutes a separate offense."
SECTION 2. This act takes effect upon approval by the Governor.
